Privacy Policy (hereinafter referred to as the “Portal”)

The following Privacy Policy is intended to inform you about our use of your personal data, with respect to which we comply with all the requirements of the Regulation of the European Parliament and of the Council (EU) 2016/679 EU of April 27, 2016. (hereinafter: “GDPR“).

  1. Data of the Administrator

The administrator of your personal data, within the meaning of GDPR, is YULIIA YASENYTSKA – PSYCHOLOG, Grochowska 42/29, 04-282 Warsaw, registered in the Register of Entrepreneurs CEiDG under NIP number 5252958113, mailing address: Grochowska 42/29, 04-282 Warsaw;

(hereinafter: “Administrator“). The Administrator can also be contacted regarding data protection issues via email address: yasenytska.poland@gmail.com. 

  1. Purposes and legal basis for data processing

Your personal data may be processed by the Administrator on the basis of:

(a) Necessity for the performance of the contract or for taking action prior to its conclusion (Article 6(1)(b) GDPR), separately for the purpose:

(i) provision of newsletter service;

(ii) to use the webinar/training/workshop/practice registration forms;

(iii) allowing access to materials related to the topics covered on the Portal;

(b) consent (Article 6(1)(a) of the GDPR), for the purpose of marketing of entities cooperating with the Administrator;

(c) the Administrator’s legitimate interest (Article 6(1)(f) GDPR), separately for the purpose:

(i) marketing of the Administrator’s own products and services, including for analytical and profiling purposes, where the Administrator’s legitimate interest is to conduct direct marketing of its own products and services. The profiling of data is for the purpose of preparing a product offering of YULIIA YASENYTSKA – PSYCHOLOGIST that takes into account the preferences of Portal users;

(ii) to use the contact forms provided by the Administrator on the Portal, where the Administrator’s legitimate interest is to take care of the Portal users and provide answers to their questions;

(iii) defense against possible claims, where the Administrator’s legitimate interest is the assertion or defense of claims.

  1. Transfer of personal data

The data may be transferred to entities processing them on our behalf on the basis of agreements concluded with the Administrator, but only for the purpose and to the extent necessary to achieve the aforementioned purposes, including, among others, entities providing IT services to us or other services to ensure the proper functioning of the Portal, with such entities processing the data only in accordance with the Administrator’s instructions.

We only transfer your data to entities located within the European Economic Area and thus subject to strict EU data protection regulations, or those that bind an appropriate security standard.

  1. Period of storage of personal data

We process your personal data only for the period necessary to fulfill the purpose of storage or as long as we are legally required to do so, in particular, until the statute of limitations for possible claims or the expiration of the archiving obligation under the law, including the obligation to retain accounting documents.

In the case of the processing of personal data for the purpose of providing the newsletter service, using the training registration forms and allowing access to materials related to the topics covered on the Portal, your personal data will be processed for the period necessary for the provision of this service, until you opt out.

If personal data are processed based on your consent, your data will be stored until you withdraw it. At any time, it is possible to withdraw consents expressed on the site, including consent to processing for marketing purposes of entities cooperating with the Administrator. The withdrawal of consent to processing will not affect the legality of processing that was performed before its withdrawal.

In the case of processing of your data on the basis of the legitimate interest of the controller, the controller will stop processing your data earlier if you successfully object to the processing.

  1. Rights conferred

Right of access to data

You have the right to obtain information regarding the personal data we hold about you, including a copy of that data.

Right to rectify data

You have the right to request the rectification of your personal data that is incorrect. Taking into account the purposes of processing, you have the right to request the completion of incomplete personal data, including by providing an additional statement.

The right to delete data

You have the right to request the deletion of your personal data stored by us in the following cases:

  • Your personal data is no longer necessary for the purposes for which it was collected,
  • you have withdrawn the consent , on which the processing is based and there is no other legal basis for processing,
  • you have lodged an objection to the processing and there are no overriding legitimate grounds for the processing or the objection relates to the processing for direct marketing purposes,
  • personal data were processed illegally,
  • personal data must be deleted in order to comply with a legal obligation under Union or national law,
  • personal data was collected in connection with the offering of information society services, as referred to in Article 8(1) of the RODO.

Right to data portability

You have the right to receive, in a structured, commonly used machine-readable format, personal data concerning you that you have provided to us, if the processing of such data is based on consent or contract and by automated means.
If you request that this data be sent to another data controller, this will be done, provided that it is technically possible.

Right to restrict data processing

You have the right to request that the processing of your personal data be restricted, in the following cases:

  • you question the accuracy of your personal data – for a period that allows us to verify the accuracy of the data,
  • processing is unlawful, and you object to the deletion of your personal data, requesting instead that its use be restricted,
  • we no longer need your personal data for the purposes of processing, but you need them to establish, assert or defend claims,
  • you have raised an objection under Article 21(1) to the processing – until it is determined whether the legitimate grounds on the part of the controller override the grounds for the objection.

Right to object to processing

If your personal data is processed on the basis of a legitimate interest of the controller, you have the right to object at any time to the processing, in accordance with Article 21 of the GDPR.

Right to withdraw consent

You have the right to withdraw your consent to the processing of personal data at any time. The withdrawal of your consent to processing will not affect the lawfulness of the processing that was carried out before the withdrawal.

The security of your personal data is our top priority, however, if you feel that we are violating the provisions of the GDPR by processing your personal data, you have the right to file a complaint with the President of the Office for Personal Data Protection.

  1. Changes to privacy policy

In order to ensure that the Portal’s Privacy Policy meets at all times the current requirements imposed by law, we reserve the right to make changes to it at any time. The above shall also apply in cases where the Privacy Policy needs to be amended to cover new or changed products or services of the Portal.

Polityka Prywatności (dalej jako: „Portal”)

Poniższa Polityka prywatności ma na celu poinformowanie o sposobie wykorzystywania przez nas Państwa danych osobowych, względem których spełniamy wszystkie wymogi Rozporządzenia Parlamentu Europejskiego i Rady (UE) 2016/679 UE z dnia 27 kwietnia 2016 r. (dalej jako: „RODO”).

  1. Dane Administratora

Administratorem Państwa danych osobowych w rozumieniu RODO, jest YULIIA YASENYTSKA – PSYCHOLOG, ul.Grochowska 42/29, 04-282 Warszawa, wpisana do Rejestru Przedsiębiorców CEiDG pod numerem NIP 5252958113, adres korespondencyjny: ul.Grochowska 42/29, 04-282 Warszawa;

(dalej jako: „Administrator”). W sprawach dotyczących ochrony danych osobowych można się skontaktować z Administratorem także za pośrednictwem adresu email  yasenytska.poland@gmail.com.

  1. Cele i podstawy prawne przetwarzania danych

Państwa dane osobowe mogą być przetwarzane przez Administratora na podstawie:

  1. a) niezbędności do wykonania umowy lub do podjęcia działań przed jej zawarciem (art. 6 ust. 1 lit. b RODO), odrębnie dla celu:

(i) świadczenia usługi newsletter;
 (ii) korzystania z formularzy zgłoszenia na webinar/szkolenie/warsztat/praktykum;
 (iii) umożliwienia dostępu do materiałów związanych z tematyką poruszaną na Portalu;

  1. b) zgody (art. 6 ust. 1 lit. a RODO), w celu prowadzenia marketingu podmiotów współpracujących z Administratorem;
  2. c) prawnie uzasadnionego interesu Administratora (art. 6 ust. 1 lit. f RODO), odrębnie dla celu:

(i) marketingu produktów i usług własnych Administratora, w tym w celach analitycznych i profilowania, gdzie uzasadnionym interesem Administratora jest prowadzenie marketingu bezpośredniego własnych produktów i usług. Profilowanie danych ma na celu przygotowanie oferty produktów YULIIA YASENYTSKA – PSYCHOLOG uwzględniającej preferencje użytkowników Portalu;
 (ii) korzystania z formularzy kontaktowych udostępnionych przez Administratora na Portalu, gdzie uzasadnionym interesem administratora jest opieka nad użytkownikami Portalu oraz udzielanie odpowiedzi na zadane pytania;
 (iii) obrony przed ewentualnymi roszczeniami, gdzie uzasadnionym interesem Administratora jest dochodzenie lub obrona roszczeń.

  1. Przekazywanie danych osobowych

Dane mogą być przekazane podmiotom przetwarzającym je na nasze zlecenie na podstawie umów zawartych z Administratorem, ale tylko w celu i zakresie niezbędnym dla realizacji ww. celów, w tym m.in. podmiotom świadczącym na naszą rzecz usługi IT lub inne usługi zapewniające prawidłowe funkcjonowanie Portalu, przy czym takie podmioty przetwarzają dane wyłącznie zgodnie z poleceniami Administratora.

Przekazujemy Państwa dane wyłącznie podmiotom umiejscowionym w ramach Europejskiego Obszaru Gospodarczego i przez to podlegającym surowym przepisom unijnym o ochronie danych, lub takim, które wiąże odpowiedni standard bezpieczeństwa.

  1. Okres przechowywania danych osobowych

Przetwarzamy Państwa dane osobowe jedynie przez okres niezbędny do spełnienia celu ich przechowywania lub dopóki jest to od nas wymagane zgodnie z prawem, w szczególności do momentu przedawnienia ewentualnych roszczeń lub wygaśnięcia obowiązku archiwizacji wynikającego z przepisów prawa, w tym obowiązku dotyczącego przechowywania dokumentów księgowych.

W przypadku przetwarzania danych osobowych w celu świadczenia usługi newsletter, korzystania z formularzy zgłoszenia na szkolenie oraz umożliwienia dostępu do materiałów związanych z tematyką poruszaną na Portalu, Państwa dane osobowe będą przetwarzane przez okres niezbędny do świadczenia tej usługi, do czasu rezygnacji z niej przez Państwa.

W razie przetwarzania danych osobowych w oparciu o wyrażoną przez Państwa zgodę, Państwa dane będą przechowywane do momentu jej wycofania. W każdej chwili istnieje możliwość wycofania zgód wyrażonych w serwisie, w tym zgody na przetwarzanie danych w celach marketingowych podmiotów współpracujących z Administratorem. Odwołanie zgody na przetwarzanie nie będzie miało wpływu na zgodność z prawem przetwarzania, którego dokonano przed jej wycofaniem.

W przypadku przetwarzania Państwa danych na podstawie prawnie uzasadnionego interesu administratora, Administrator przestanie wcześniej przetwarzać dane jeżeli zgłosi Pani/Pan skutecznie sprzeciw wobec przetwarzania danych.

  1. Przysługujące prawa

Prawo dostępu do danych

Mają Państwo prawo uzyskać informację odnośnie przechowywanych przez nas danych osobowych na Państwa temat, w tym kopię tych danych.

Prawo do sprostowania danych

Mają Państwo prawo żądania sprostowania Państwa danych osobowych, które są nieprawidłowe. Z uwzględnieniem celów przetwarzania mają Państwo prawo żądania uzupełnienia niekompletnych danych osobowych, w tym poprzez przedstawienie dodatkowego oświadczenia.

Prawo do usunięcia danych

Mają Państwo prawo domagać się usunięcia Państwa danych osobowych przechowywanych przez nas w następujących przypadkach:

  • Państwa dane osobowe nie są już niezbędne do celów, w których zostały zebrane,
  • cofnęliście Państwo zgodę , na której opiera się przetwarzanie i nie ma innej podstawy prawnej przetwarzania,
  • wnieśliście Państwo sprzeciw wobec przetwarzania i nie występują nadrzędne prawnie uzasadnione podstawy przetwarzania lub sprzeciw dotyczy przetwarzania danych w celach marketingu bezpośredniego,
  • dane osobowe były przetwarzane niezgodnie z prawem,
  • dane osobowe muszą zostać usunięte w celu wywiązania się z obowiązku prawnego przewidzianego w prawie Unii lub prawie krajowym,
  • dane osobowe zostały zebrane w związku z oferowaniem usług społeczeństwa informacyjnego, o których mowa w art. 8 ust. 1 RODO.

     

Prawo do przenoszenia danych

Mają Państwo prawo otrzymać w ustrukturyzowanym, powszechnie używanym formacie nadającym się do odczytu maszynowego dane osobowe dotyczące Państwa, które nam dostarczyliście, jeżeli przetwarzanie tych danych odbywa się na podstawie zgody lub umowy oraz w sposób zautomatyzowany.
 Jeżeli domagają się Państwo przesłania tych danych do innego administratora danych, zostanie to zrealizowane, o ile istnieje taka możliwość techniczna.

Prawo ograniczenia przetwarzania danych

Mają Państwo prawo zażądać, aby przetwarzanie Państwa danych osobowych zostało ograniczone, w następujących przypadkach:

  • kwestionują Państwo prawidłowość danych osobowych – na okres pozwalający nam sprawdzić prawidłowość tych danych,
  • przetwarzanie jest niezgodne z prawem, a Państwo sprzeciwiacie się usunięciu danych osobowych, żądając w zamian ograniczenia ich wykorzystywania,
  • nie potrzebujemy już danych osobowych do celów przetwarzania, ale są one Państwu potrzebne do ustalenia, dochodzenia lub obrony roszczeń,
  • wnieśliście Państwo sprzeciw na mocy art. 21 ust. 1 wobec przetwarzania – do czasu stwierdzenia, czy prawnie uzasadnione podstawy po stronie administratora są nadrzędne wobec podstaw sprzeciwu.

     

Prawo do wniesienia sprzeciwu wobec przetwarzania

Jeżeli Państwa dane osobowe są przetwarzane na podstawie prawnie uzasadnionego interesu administratora, mają Państwo prawo do sprzeciwu w dowolnym czasie wobec przetwarzania, zgodnie z art. 21 RODO.

Prawo do wycofania zgody

Mają Państwo prawo do wycofania wyrażonej zgody na przetwarzanie danych osobowych w dowolnej chwili. Odwołanie zgody na przetwarzanie nie będzie miało wpływu na zgodność z prawem przetwarzania, którego dokonano przed jej wycofaniem.

Bezpieczeństwo danych osobowych jest dla nas priorytetem, jeśli jednak uznają Państwo, że przetwarzając Państwu dane osobowe naruszamy przepisy RODO, mają Państwo prawo wniesienia skargi do Prezesa Urzędu Ochrony Danych Osobowych.

  1. Zmiany w Polityce prywatności

W celu zapewnienia, iż Polityka prywatności Portalu spełnia przez cały czas aktualne wymogi nałożone w przepisach prawa, zastrzegamy sobie prawo do wnoszenia do niej zmian w dowolnym czasie. Powyższe ma również zastosowanie w przypadkach, gdy Polityka prywatności wymaga zmian w celu objęcia nią nowych lub zmienionych produktów lub usług Portalu.
