General Terms and Conditions

§ 1 Definitions

(1) Whenever terms defined below appear in these Regulations, they shall be understood as follows:

  1. Regulations – these Regulations;
  2. Service Provider or Organizer – YULIIA YASENYTSKA – PSYCHOLOGIST, 42/29 Grochowska St., 04-282 Warsaw, registered in the Register of Entrepreneurs of CEiDG (Central Electronic Register and Information on Economic Activity) under the NIP number 5252958113, https://yesidoit.com, mailing address: 42/29 Grochowska St., 04-282 Warsaw;
  3. Customer – an individual, legal person or organizational unit to which the Civil Code grants legal personality;
  4. Participant – an adult natural person participating in the webinar; a Participant is also considered to be a person for whose benefit access to the webinar has been purchased (made available) by a third party (the Ordering Party);
  5. Parties – collectively, the Service Provider/Organizer and the Customer;
  6. Party – the Service Provider/Organizer or the Service Recipient;
  7. Agreement – a civil law agreement concluded between the Parties, the subject of which is the Participant’s paid or free participation in the webinar. Unless the Parties agree otherwise, their rights and obligations under the Agreement shall be governed by these Terms and Conditions;
  8. Services – are Webinars, Trainings, Courses, Practice that are provided by the Organizer under the terms of this Offer.
  9. Webinar – is an online video lesson, online lecture, online workshop or online course (two or more Webinars) that takes place in real time and/or is transmitted via Internet technologies, consisting of the transmission of information through the demonstration of original methods of assimilating specific content by providing Participants with a Personal Link under the terms of this Offer;
  10. Site Link – is an alphanumeric code or other code that allows access to the Organizer’s Site;
  11. Personal link – is a personal alphanumeric code or other code that allows the Participant to access the Webinar.
  12. Training – a web-based seminar service of an informative nature provided by the Service Provider regardless of the form (lecture, set of lectures, interactive lecture, online debate, thematic interview with a specialist, training, courses, workshops), aimed at obtaining or supplementing the knowledge of Participants;
  13. Practice – is a short course that takes place with the Participant on a specific date, using homework assignments and practical exercises under the terms of this Offer.
  14. Participant Package – is a designation of the range of services within one Service, affecting its value. Within a single Service, Participants may select any of the Participant Packages on the Site or under the terms of this Offer.
  15. Participant Registration (hereinafter – Registration) – is the provision of personal information by the Participant by filling out a form on the Site/on the educational platform and/or accessing the Site/the educational platform via a link, followed by the provision of personal information and/or the provision of personal information via telephone, messenger messages, WhatsApp, Instagram direct messages, in comments to posts or videos, in a chatbot to the Organizer;
  16. Questionnaire – is a paper or electronic document that, when completed, signed and submitted to the Organizer, entitles the Participant of a Training, Course, Internship, Webinar to receive the Organizer’s Services under the terms of this Offer.
  17. Website/Site – the website https://yesidoit.com including thematic sub-sites or any other service owned by the Service Provider on which the webinar is hosted;
  18. Data – data, including the Participant’s personal data, provided by the Service Recipient when entering into the Agreement or provided by the Participant when using the webinar;
  19. Agreement – an agreement to provide an opportunity for one Participant to participate in a webinar;
  20. GDPR – Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation) (Official Journal of the EU.L 2016 No. 119, p. 1, as amended), also the Law of May 10, 2018. (Journal of Laws 2018 Item 1000, as amended);
  21. Consumer Rights Act – Act of May 30, 2014 on consumer rights (i.e., Journal of Laws of 2019, item 134, as amended).

 

§ 2 RULES OF PARTICIPATION IN THE WEBINAR

  1. The Organizer’s website provides basic information regarding the terms, conditions, procedure and timing of the Webinar. To participate in the Webinar, the Participant must register and meet all the terms and conditions of this Offer.
  2. Once the Participant has registered for the Webinar, a notification will be sent to the Participant’s designated e-mail address prior to the start of the Webinar broadcast, containing a link that is valid only for that Participant. Clicking on it by the Participant confirms that he/she has read the terms and conditions of this Offer, which allows access to the Webinar transmission page. If the link to the Webinar recording is made available, all terms and conditions of this Offer are imposed on the Participant.
  3. Participants shall independently provide appropriate technical conditions for their personal computer or other mobile device in order to participate in the Webinar.
  4. The Organizer shall not be liable for the Participant’s inability to participate in the Webinar due to reasons beyond the Organizer’s control.
  5. The Organizer reserves the right to independently determine the date, time and topic of the Webinar, its duration, change (move) or cancel it, notifying the Participant at the e-mail address provided during registration.
  6. In the event that the Organizer decides to change the date and/or time of the Webinar, Participants who were to attend the corresponding Webinar will receive notification of the new date and/or time, and a link to attend such Webinar to the e-mail address indicated during registration.
  7. The Organizer reserves the right not to allow Participants who have violated or failed to meet the terms of this Offer to participate in the Webinar.
  8. The Organizer reserves the right to provide Webinar Participants with a link to the recording of the conducted Webinar (if available) and/or additional materials, providing after-sales support under the terms of the Participant Package.
  9. In the event of the Participant’s absence from the Webinar, including for reasons beyond the control of the Organizer, the Participant shall not have the right to request that the Webinar be held again or that the information contained in the Webinar be made available in another form. In doing so, the services provided by the Organizer are considered to have been provided accordingly. The Organizer reserves the right to provide the Participant with a link to the recording of the conducted Webinar (if available) and/or additional materials.
  10. In case of violation of ethical standards and/or dissemination of information of an advertising or other nature, inappropriate behavior of the Participant that impedes the conduct of the Webinar, the Organizer shall have the right, at its sole discretion, to terminate the access of such Participant to send messages during the Webinar.
  11. During the Webinar, Participants shall have the right, if technically possible, to ask questions concerning only the topic and content of the Webinar, unless the person conducting it informs about other rules for asking and answering questions. Restrictions may be set by the Organizer for the entire Webinar or a specific duration of the Webinar.

 

§ 3 PARTICIPATION RIGHTS DURING PRACTICE

  1. The Organizer’s website provides basic information on the terms and conditions and dates of the Referral Practice. In order to participate in the Practice, the Participant must register and meet all the terms and conditions of this Offer.
  2. Completion of the Pre-Internship Survey and submission of it to the Organizer is one of the mandatory conditions for the Participant’s admission to the Internship.
  3. The Organizer shall not be responsible for the inability of the Participant to participate in the Practice, which resulted from reasons beyond the control of the Organizer.
  4. The Organizer shall have the right, at its sole discretion, to set the start date and duration of the Apprenticeship, change (move) and cancel it, notifying the Participant at the contact email address indicated during registration.
  5. In the event that the Company decides to change the date and time of the Practice, Participants shall receive notification of such changes.
  6. The Company shall have the right not to allow a Participant who has violated or failed to perform the terms of this Offer to participate in the Practice.
  7. If the Participant is absent from the Practice without notifying the Organizer, in accordance with Item. § 6, item 1 d) of the Offer, including for reasons beyond the Organizer’s control, the Participant shall not have the right to request that it be re-conducted or that the information contained in the Practice be made available in another form. In doing so, the Organizer’s services are considered to have been provided accordingly. The Organizer reserves the right to provide such Participant with a link to the recording of the conducted Practicum (if available) and/or additional materials. At its own discretion, the Organizer has the right to offer such Participant to participate in an analogous subsequent Apprenticeship or to substitute a type of service under the terms of this Offer.
  8. For violation of ethical standards and/or dissemination of information of an advertising or other nature, inappropriate behavior of the Participant that hinders the conduct of the Apprenticeship, the Organizer has the right at its sole discretion to interrupt the provision of services to that Participant. In doing so, the cost of the Apprenticeship in which the provision of services has been interrupted shall not be refunded to the Participant.
  9. The Organizer reserves the right to provide Practice Participants with a link to the recording of the conducted Practice (if available) and/or additional materials, providing support after its completion under the terms of the Participant’s Package.

§ 4 RIGHTS OF PARTICIPATION IN THE COURSE

  1. The Organizer’s website provides basic information on the conditions, procedure and deadlines for the Course. In order to participate in the Course, the Participant must register and meet all the terms and conditions of this Offer.
  2. Completion of the Questionnaire prior to the start of the Course and its submission to the Organizer is one of the mandatory conditions for admission of the Participant to the Course.
  3. The Organizer shall not be responsible for the inability of the Participant to participate in the Course, which resulted from reasons beyond the Company’s control.
  4. The company shall have the right at its sole discretion to determine the topic of the Course, its duration, lecturers, change (move) and cancel it, informing the Participant.
  5. The Company shall agree with the Participant on the date and time of commencement of the Course, as well as the possibility of changing them, provided that the Participant is informed in advance of his inability to participate on the date agreed with the Organizer.
  6. In the case of systematic omission (two or more times) of the Course without prior (at least 12 hours before) notification by the Participant of his/her inability to attend the date agreed with the Organizer, for reasons beyond the control of the Organizer, the Organizer reserves the right to provide such Participant with additional materials (if available) and at its sole discretion to offer a change in the type of service under the terms of this Offer. In doing so, the Organizer’s services shall be deemed to have been provided accordingly.
  7. The Organizer shall have the right not to allow a Participant who has violated or failed to perform the terms of this Offer to participate in the Course.
  8. In the case of violation of ethical standards and/or other inappropriate behavior of the Course Participant, the Organizer has the right, at its sole discretion, to interrupt the provision of services to that Participant. When doing so, the cost of the Course, during which the provision of services was interrupted, shall not be refunded to the Participant.

§ 5 OBLIGATIONS OF THE ORGANIZER

    1. The organizer has the right to:

a) Refuse to provide the Participant with the Services under the terms of this Offer.
b) Maintain photographs and video recordings during the provision of the Services and use the materials obtained at their own discretion.
c) Create Participant Packages, develop programs, topics and duration of Services provided to Participants, set the date for the performance of Services, change (transfer) and cancel, determine the number and composition of actors performing during the provision of the Service.
d) Based on the email address received from the Participant, carry out mass mailing of informative communications without the consent of the Participant and/or those who have provided their data on the Organizer’s website. We will always provide you with the opportunity to opt out of such communications by providing an unsubscribe link
e) Employ third parties to provide the Service or specific parts thereof.
f) Unilaterally make changes to the terms of this Offer, in particular, but not limited to, changing the payment terms for the provision of the Services, making changes to the way the Services are provided by posting a new redaction of the Offer on the website.

2. Responsibilities of the Organizer:

a) Provide the Services under the terms of this Offer.
b) Retain the information and data (including personal data) provided by the Participant to carry out the terms and conditions of this Offer in accordance with applicable data protection laws.
c) Provide consultative support to Participants regarding the Organizer’s services and the terms and conditions for obtaining them under the terms of this Offer.
d) Fully reimburse the Participant only in the event of full cancellation by the Organizer of the Services paid for by the Participant. The refund shall be made in non-cash form within 15 calendar days from the date of cancellation by the Participant of the paid Services.

 

§ 6 RIGHTS AND OBLIGATIONS OF THE PARTICIPANT

1. The participant has the right to:

a) Contact the Organizer for information about the Organizer’s Services, their terms and conditions and the terms and conditions of this Offer at the telephone numbers listed on the Website and/or through the contact forms, as well as by mail or other means of communication from 9:00 a.m. to 6:00 p.m. (Kyiv time), except Saturdays, Sundays and holidays, according to the Company’s work schedule.
b) Receive any of the proposed Organizer Services under the terms of this Offer.
c) Resign from receiving the Service before payment.
d) Under the terms of the Offer, receipt of a fully paid service cannot be independently transferred to the nearest date set by the Organizer, but the possibility of such an exchange may be individually agreed with the Organizer, provided that the Organizer is notified 7 business days prior to the inability to receive the Service. Such a transfer can take place only once and only with the consent of the Organizer.

2. Responsibilities of the Participant:
a) Read the applicable terms and conditions before accepting the Offer.
b) Perform the terms and conditions of this Offer.
c) Ensure timely appearance to receive the Service.
d) Pay the Company’s Services on time and in full in accordance with the terms and conditions set forth in this Agreement.

3. A participant shall be prohibited from participating, except as provided for a specific Service or Participant Package:
a) Distribute materials related to the Services provided, including video and audio.
b) Distribute the materials of the Service in the form of transcription, that is, translation of audio and video materials into text format, and/or translation into other languages.
c) Use the information obtained from the Organizer for commercial purposes by translating or sharing knowledge and bases without prior agreement with the Organizer.
d) Use the information obtained from the Organizer, including (without limitation) for the purpose of creating a similar and/or competitive service or service, or for commercial or financial gain without prior agreement with the Organizer.
e) Organize and conduct its own events or activities based on the Organizer Services.
f) Take actions to violate the terms of this Offer.
g) Share and/or provide access to the Services to third parties, except under the terms of this Offer.
h) Permit dissemination of false, untrue information, information defaming the dignity, business reputation of the Organizer, lecturers and others, as well as information inciting international, ethnic intolerance, hostility, war, change of the state system of countries, information whose dissemination is prohibited by the applicable provisions of Polish law and international law standards depending on the territory of the Services.

4. Take other actions that are not stipulated in the Offer, but contain elements of a criminal or administrative offense, or violate the rights and interests of the Organizer, other Participants and/or third parties

§ 7 PRICE OF SERVICES AND TERMS OF PAYMENT

  1. The price of the Organizer’s services for participant packages (if participant packages are available) is published on the website and may change depending on the upcoming date of the service. Information on the current price of the service is posted on the website.
  2. Payment is made by transferring funds to the company’s current account in Polish zlotys, as well as in foreign currencies, such as US dollars / euros, through payment via the PayPal/Stripe/WayForPay payment systems.
  3. The service is provided by the company upon full payment of 100 (one hundred) percent by the participant. Such payment implies the participant’s familiarization with and full agreement to all terms and conditions of the offer.
  4. The participant has the right to pay the value of services in installments, with the price of the service in effect for the participant at the time of payment of the first installment.
  5. The moment of payment is the crediting of funds to the current account of the Organizer in accordance with the payment method selected by the participant.
  6. Under the terms and conditions to be announced during the provision of the service, the Organizer may offer a promotional price (price with discount and limited offer period) for the purchase of the next service.
  7. Participants have the opportunity to receive individual bonuses, privileges, discounts from the Organizer at her own discretion.
  8. The Organizer may organize free webinars and trainings for participants. All terms and conditions of this offer apply to such free webinars, marathons and trainings.


§ 8 LIABILITY OF THE COMPANY AND PARTICIPANT. TERMS AND CONDITIONS OF DISPUTE RESOLUTION

  1. The Organizer does not make any warranties to the Participant regarding the services provided, including (but not limited to): continuity, timeliness, security, flawlessness, exact fit to resolve specific issues and expectations of the Participant.
  2. The Participant shall be fully responsible for the consequences of any kind, including, but not limited to, the expected results and outcomes of the service obtained, which may result from its provision by the Organizer.
  3. In the event that a Participant knowingly provides false data in accordance with Paragraph 9(5) of the Offer, the Organizer shall not be held liable and claims by such Participants shall not be considered.
  4. In case of interference with the functioning of the Internet network, hardware, software of the Participant, the Organizer is not responsible for the inability to provide the service.
  5. The Organizer shall not be liable for any damages incurred by the Participant, including, but not limited to, resulting from acts or omissions, providing false information to other Participants.
  6. The total liability of the Organizer for any claims and/or complaints (including, but not limited to, failure to perform the terms of the Offer) shall not exceed the amount paid by the Participant for the Organizer’s Service.
  7. The organizer is not an educational institution and is not engaged in any educational (pedagogical) activity.
  8. The Organizer is not responsible for obtaining a result that is not in accordance with the Participant’s expectations, since the success of the Participant’s use of the obtained information depends on many factors unknown to the Organizer: determination, perseverance, other individual characteristics and personal characteristics of the Participant.
  9. The Organizer is not responsible for the inconsistency of the content of the Service with the expectations of the Participant. The content of the Service represents the private opinion of the lecturer, which may differ from the Participant’s opinion.
  10. under no circumstances shall the Organizer be liable to third parties for the use of links and information obtained by the Participant during the Service and provided by the Participant, as well as for decisions made and/or by Participants and/or by third parties based on information obtained by Participants during the provision of the Service by the Organizer.
  11. Under no circumstances shall the Organizer be liable to the Participant and/or to any third party for any direct and/or indirect damages arising from any use of information from the Site or from any other website linked to the Site, resulting from access, use or inability to use the Site, information obtained from the Organizer in the course of providing any service.
  12. The Organizer shall not be liable for failure to perform or improper performance of its obligations under this Offer if such failure or improper performance is due to force majeure (extraordinary circumstances). In the event of extraordinary circumstances against the Organizer, the Organizer shall notify the Site not less than 10 (ten) calendar days from the date of their occurrence.
  13. Any disputes arising from the services provided shall be resolved amicably in the first instance.
  14. If the relevant dispute cannot be resolved amicably, it will be resolved by a court with jurisdiction over the registered office of the Organizer.

§ 9 OTHER CONDITIONS

  1. All commercial information between the Organizer and the Participant, including but not limited to information about the Organizer, Participants, third parties, technology, shall be considered confidential.
  2. The administrator of the Participant’s personal data is the Organizer (YULIIA YASENYTSKA – PSYCHOLOG, 42/29 Grochowska St., 04-282 Warsaw, entered in the Register of Entrepreneurs of CEiDG under the NIP number 5252958113).
  3. The participant has the right to inspect and the right to delete the personal data provided. The statement in this regard should be sent in writing to the Organizer’s address.
  4. The participant, by providing personal data, declares under pain of legal liability that:
    a. they are truthful,
    b. consents to the processing of such data by the Service Provider for the purposes and to the extent specified during registration.
  5. For the processing of personal data, which are listed in § 9 item. 4 of this Offer, first name, last name, contact telephone number, e-mail address and survey data may be processed.
  6. Personal data processed for the purpose of entering into or executing the Agreement or providing access to the webinar content and fulfilling the Service Provider’s legal obligation will be kept for the duration of the Agreement, and after its expiration for the period necessary for: post-sale service to the Orderers (e.g. handling complaints), securing or pursuing potential claims to which the Organizer is entitled, fulfilling other legal obligations of the Organizer (e.g. under tax or accounting regulations).
  7. Personal data processed for the purpose of marketing of own products or services of YULIIA YASENYTSKA – PSYCHOLOG, Grochowska 42/29, 04-282 Warsaw, entered in the Register of Entrepreneurs of CEiDG under the NIP number 5252958113 on the basis of legitimate legal interest will be processed until an objection is raised by the data subject; personal data processed on the basis of a separate consent will be stored until it is revoked or the period to which the consent pertained expires. If consent is granted for the Organizer to process transmission data for the purpose of marketing the Organizer’s telecommunications services, the data will be processed only for the duration of the Agreement. The personal (contact) data of the Orderers may be transferred to entities cooperating with the Organizer in the organization of the webinar.
  8. With respect to data protection, the Participant shall have the following rights:

1) The right to access the content of your personal data, i.e. the right to obtain confirmation of whether the Organizer is processing your data, and information regarding such processing,

2) The right to rectify data if the data processed by the Organizer is incorrect or incomplete,

3) The right to request the Organizer to delete the data,

4) The right to request the Organizer to restrict data processing,

5) The right to data portability, i.e. the right to receive personal data provided to the Organizer and send it to another controller,

6) The right to object to the processing of data on the basis of the legitimate interest of the Organizer or to processing for direct marketing purposes,

7) The right to lodge a complaint with the Polish supervisory authority or the supervisory authority of another European Union member state with jurisdiction over the data subject’s habitual residence or work, or over the place of the alleged violation of the RODO,

8) The right to withdraw consent at any time (without affecting the legality of the

processing that was carried out on the basis of consent before its revocation),

9) The right to obtain the intervention of a human being (e.g., an employee) on the part of the Organizer, to express one’s position and to challenge a decision based on automated data processing.

  1. The provisions of this paragraph shall apply mutatis mutandis to Participants if their personal data have been provided to the Organizer for processing.

10) In the event that the Participant cancels receipt of the Service, any claim by the Participant in this regard shall not be accepted and shall not be considered by the Organizer.

11) A Participant shall receive Services in accordance with the terms and conditions of this Offer only after fulfilling all mandatory conditions for the Participant’s admission to receive Services.

12) The offer has been approved by the Organizer and is valid for the entire period of the Services.

Ogólne Warunki Umowy

§ 1 Definicje

1. Ilekroć w niniejszym Regulaminie występują poniżej zdefiniowane pojęcia, należy je rozumieć w sposób następujący:

  1. Regulamin – niniejszy Regulamin;
  2. Usługodawca lub Organizator – YULIIA YASENYTSKA – PSYCHOLOG, ul.Grochowska 42/29, 04-282 Warszawa, wpisana do Rejestru Przedsiębiorców CEiDG pod numerem NIP 5252958113, https://yesidoit.com, adres korespondencyjny: ul.Grochowska 42/29, 04-282 Warszawa;
  3. Usługobiorca – osoba fizyczna, osoba prawna lub jednostka organizacyjna, której kodeks cywilny przyznaje osobowość prawną;
  4. Uczestnik – pełnoletnia osoba fizyczna uczestnicząca w webinarium; za Uczestnika uważa się również osobę, na rzecz której został wykupiony (udostępniony) dostęp do webinarium przez stronę trzecią (Zamawiającego);
  5. Strony – łącznie Usługodawca/Organizator i Usługobiorca;
  6. Strona – Usługodawca/Organizator lub Usługobiorca;
  7. Umowa – zawarta pomiędzy Stronami umowa cywilnoprawna, której przedmiotem jest płatny lub bezpłatny udział Uczestnika w webinarium. O ile Strony zgodnie nie postanowią inaczej, ich prawa i obowiązki w ramach Umowy reguluje niniejszy Regulamin;
  8. Usługi – to Webinary, Szkolenia, Kursy, Praktyka, które są świadczone przez Organizatora na warunkach tej Oferty.
  9. Webinar – to lekcja wideo online, wykład online, warsztat online lub kurs online (dwa lub więcej Webinarów), które odbywają się w czasie rzeczywistym i/lub są transmitowane za pomocą technologii internetowych, polegających na przekazywaniu informacji poprzez demonstrację oryginalnych metod przyswajania określonej treści poprzez udostępnienie Uczestnikom Osobistego linku na warunkach tej Oferty;
  10. Link do strony – to alfanumeryczny kod lub inny kod, który umożliwia dostęp do Strony Organizatora;
  11. Osobisty link – to osobisty alfanumeryczny kod lub inny kod, który umożliwia Uczestnikowi dostęp do Webinaru.
  12. Szkolenie – usługa internetowego seminarium o charakterze informacyjnym realizowana przez Usługodawcę niezależnie od formy (wykład, zespół wykładów, wykład interaktywny, debata internetowa, wywiad tematyczny ze specjalistą, szkolenia, kursy, warsztaty), mająca na celu uzyskanie lub uzupełnienie wiedzy Uczestników;
  13. Praktyka – to krótkotrwały kurs, który odbywa się z Uczestnikiem w określonym terminie, wykorzystujący zadania domowe i praktyczne ćwiczenia na warunkach tej Oferty.
  14. Pakiet Uczestnika – to oznaczenie zakresu usług w ramach jednej Usługi, wpływające na jej wartość. W ramach jednej usługi Uczestnicy mogą wybrać dowolny z Pakietów Uczestnika na Stronie lub na warunkach tej Oferty.
  15. Rejestracja Uczestnika (dalej – Rejestracja) – to udostępnienie przez Uczestnika swoich danych osobowych poprzez wypełnienie formularza na Stronie/na platformie edukacyjnej i/lub przejście na Stronę/ na platformę edukacyjną za pośrednictwem linku, po czym następuje podanie danych osobowych i/lub udostępnienie danych osobowych za pośrednictwem telefonu, wiadomości w komunikatorze, WhatsAppie, na Instagramie w wiadomościach prywatnych, w komentarzach pod postem lub wideo, w czacie bota Organizatorowi;
  16. Ankieta – to dokument papierowy lub elektroniczny, który po wypełnieniu, podpisaniu i przekazaniu Organizatorowi uprawnia Uczestnika Szkolenia, Kursu, Praktyki, Webinaru do otrzymania Usług Organizatora na warunkach tej Oferty.
  17. Serwis/strona WWW – serwis internetowy https://yesidoit.com wraz z podstronami tematycznymi lub inny serwis będący własnością Usługodawcy, na którym posadowiono webinarium;
  18. Dane – dane, w tym dane osobowe Uczestnika, podane przez Usługobiorcę podczas zawarcia Umowy lub podane przez Uczestnika podczas korzystania z webinarium;
  19. Umowa – umowa dotycząca zapewnienia możliwości uczestnictwa w webinarium jednemu Uczestnikowi;
  20. RODO – Rozporządzenie Parlamentu Europejskiego i Rady (UE) 2016/679 z dnia 27 kwietnia 2016 r. w sprawie ochrony osób fizycznych w związku z przetwarzaniem danych osobowych i w sprawie swobodnego przepływu takich danych oraz uchylenia dyrektywy 95/46/WE (ogólne rozporządzenie o ochronie danych) (Dz.Urz.UE.L 2016 Nr 119, str. 1, ze zm.), również ustawa z 10 maja 2018 r. (Dz.U. 2018 poz. 1000 z późn. zm.);
  21. Ustawa o prawach konsumenta – Ustawa z dnia 30 maja 2014 r. o prawach konsumenta (t.j. Dz.U. z 2019 r. poz. 134 ze zm.).

    § 2 ZASADY UCZESTNICTWA W WEBINARZE

    1. Na stronie internetowej Organizatora podane są podstawowe informacje dotyczące warunków, procedury i terminów przeprowadzania Webinaru. Aby wziąć udział w Webinarze, Uczestnik musi się zarejestrować i spełnić wszystkie warunki niniejszej Oferty.
    2. Po zarejestrowaniu się na Webinar, na wskazany przez Uczestnika adres e-mail przed rozpoczęciem transmisji Webinaru zostanie wysłane powiadomienie o możliwości udziału w Webinarze, zawierające link, który jest ważny tylko dla tego Uczestnika. Kliknięcie w niego przez Uczestnika potwierdza jego zapoznanie się z warunkami niniejszej Oferty, co umożliwia dostęp do strony transmisji Webinaru. W przypadku udostępnienia linku do nagrania Webinaru, na Uczestnika nakładane są wszystkie warunki niniejszej Oferty.
    3. Uczestnicy samodzielnie zapewniają odpowiednie warunki techniczne dla swojego komputera osobistego lub innego urządzenia mobilnego w celu uczestnictwa w Webinarze.
    4. Organizator nie ponosi odpowiedzialności za niemożność udziału Uczestnika w Webinarze wynikającą z przyczyn niezależnych od Organizatora.
    5. Organizator zastrzega sobie prawo do samodzielnego ustalania daty, godziny i tematu Webinaru, jego czasu trwania, zmiany (przeniesienia) lub odwołania, informując o tym Uczestnika na podany podczas rejestracji adres e-mail.
    6. W przypadku gdy Organizator zdecyduje o zmianie daty i/lub godziny Webinaru, Uczestnicy, którzy mieli wziąć udział w odpowiednim Webinarze, otrzymają powiadomienie o nowej dacie i/lub godzinie, oraz link do udziału w takim Webinarze na wskazany podczas rejestracji adres e-mail.
    7. Organizator zastrzega sobie prawo do nie dopuszczenia do udziału w Webinarze Uczestników, którzy naruszyli lub nie spełnili warunków niniejszej Oferty.
    8. Organizator zastrzega sobie prawo do udostępnienia Uczestnikom Webinaru linku do nagrania przeprowadzonego Webinaru (jeśli jest dostępne) oraz/lub dodatkowych materiałów, świadcząc wsparcie posprzedażowe na warunkach Pakietu Uczestnika.
    9. W przypadku nieobecności Uczestnika na Webinarze, w tym z przyczyn niezależnych od Organizator, Uczestnik nie ma prawa żądać ponownego przeprowadzenia Webinaru ani udostępnienia informacji zawartych w Webinarze w innej formie. Przy tym usługi świadczone przez Organizator uważane są za dostarczone odpowiednio. Organizator zastrzega sobie prawo do udzielenia Uczestnikowi linku do nagrania przeprowadzonego Webinaru (jeśli jest dostępne) oraz/lub dodatkowych materiałów.
    10. W przypadku naruszenia norm etycznych i/lub rozpowszechniania informacji o charakterze reklamowym lub innym, niewłaściwego zachowania się Uczestnika, które utrudnia przeprowadzenie Webinaru, Organizator ma prawo według własnego uznania zakończyć dostęp takiego Uczestnika do wysyłania wiadomości podczas Webinaru.
    11. Podczas trwania Webinaru Uczestnicy mają prawo, jeśli istnieje taka możliwość techniczna, zadawać pytania dotyczące wyłącznie tematu i treści Webinaru, jeśli osoba prowadząca go nie poinformuje o innych zasadach zadawania pytań i odpowiedzi na nie. Ograniczenia mogą być ustalane przez Organizatora dla całego Webinaru lub określonego czasu jego trwania.

    § 3 PRAWA UCZESTNICTWA PODCZAS PRAKTYKI

    1. Na stronie internetowej Organizatora podane są podstawowe informacje dotyczące warunków i terminów przeprowadzania Praktyki stosowania poleceń. Aby wziąć udział w Praktyce, Uczestnik musi się zarejestrować i spełnić wszystkie warunki niniejszej Oferty.
    2. Wypełnienie Ankiety przed Praktyką i przekazanie jej Organizatorowi jest jednym z obowiązkowych warunków dopuszczenia Uczestnika do udziału w Praktyce.
    3. Organizator nie ponosi odpowiedzialności za niemożność udziału Uczestnika w Praktyce, która wyniknęła z przyczyn niezależnych od Organizatora.
    4. Organizator ma prawo według własnego uznania ustalać datę rozpoczęcia oraz czas trwania Praktykum, zmieniać (przenosić) i anulować go, informując o tym Uczestnika na wskazany podczas rejestracji kontaktowy adres e-mail.
    5. W przypadku gdy Firma zdecyduje o zmianie daty i czasu rozpoczęcia Praktyki, Uczestnicy otrzymują powiadomienie o takich zmianach.
    6. Firma ma prawo nie dopuszczać do udziału w Praktyce Uczestnika, który naruszył lub nie wykonał warunków niniejszej Oferty.
    7. W przypadku nieobecności Uczestnika na Praktyce bez uprzedzenia Organizatora, zgodnie z pkt. § 6 pkt 1 d) Oferty, w tym z przyczyn niezależnych od Organizatora, Uczestnik nie ma prawa żądać jego ponownego przeprowadzenia ani udostępnienia informacji zawartych w Praktykumie w innej formie. Przy tym usługi Organizatora uważane są za dostarczone odpowiednio. Organizator zastrzega sobie prawo udzielenia takiemu Uczestnikowi linku do nagrania przeprowadzonego Praktykum (jeśli jest dostępne) oraz/lub dodatkowych materiałów. Na własne uznania Organizator ma prawo zaproponować takiemu Uczestnikowi udział w analogicznym następnym Praktykumie lub zastąpić rodzaj usługi na warunkach niniejszej Oferty.
    8. Za naruszenie norm etycznych i/lub rozpowszechnianie informacji o charakterze reklamowym lub innym, nieodpowiednie zachowanie się Uczestnika, które utrudnia przeprowadzenie Praktykum, Organizator ma prawo według własnego uznania przerwać świadczenie usług temu Uczestnikowi. Przy tym koszt Praktykum, w którym świadczenie usług zostało przerwane, nie jest zwracany Uczestnikowi.
    9. Organizator zastrzega sobie prawo udzielenia Uczestnikom Praktykum linku do nagrania przeprowadzonego Praktykum (jeśli jest dostępne) oraz/lub dodatkowych materiałów, świadcząc wsparcie po jego zakończeniu na warunkach Pakietu Uczestnika.

    § 4 PRAWA UCZESTNICTWA W KURSIE

    1. Na stronie internetowej Organizatora podane są podstawowe informacje dotyczące warunków, procedury i terminów przeprowadzania Kursu. Aby wziąć udział w Kursie, Uczestnik musi się zarejestrować i spełnić wszystkie warunki niniejszej Oferty.
    2. Wypełnienie Ankiety przed rozpoczęciem Kursu i przekazanie jej Organizatorowi jest jednym z obowiązkowych warunków dopuszczenia Uczestnika do udziału w Kursie.
    3. Organizator nie ponosi odpowiedzialności za niemożność udziału Uczestnika w Kursie, która wyniknęła z przyczyn niezależnych od Firmy.
    4. Firma ma prawo według własnego uznania ustalać temat Kursu, jego czas trwania, wykładowców, zmieniać (przenosić) i anulować go, informując o tym Uczestnika.
    5. Firma uzgadnia z Uczestnikiem datę i czas rozpoczęcia Kursu, a także możliwość ich zmiany pod warunkiem wcześniejszego poinformowania Uczestnika o niemożności uczestnictwa w ustalonej z Organizatorem terminie.
    6. W przypadku systematycznego opuszczania (dwa lub więcej razy) Kursu bez wcześniejszego (najpóźniej na 12 godzin przed) powiadomienia przez Uczestnika o niemożności uczestnictwa w ustalonym z Organizatorem terminie, z przyczyn niezależnych od Organizatora, Organizator zastrzega sobie prawo udzielenia takiemu Uczestnikowi dodatkowych materiałów (jeśli są dostępne) oraz według własnego uznania zaproponowania zmiany rodzaju usługi na warunkach niniejszej Oferty. Przy tym usługi Organizatora uważane są za dostarczone odpowiednio.
    7. Organizator ma prawo nie dopuszczać do udziału w Kursie Uczestnika, który naruszył lub nie wykonał warunków niniejszej Oferty.
    8. W przypadku naruszenia norm etycznych i/lub innej nieodpowiedniej zachowania się Uczestnika Kursu, Organizator ma prawo według własnego uznania przerwać świadczenie usług temu Uczestnikowi. Przy tym koszt Kursu, w trakcie którego świadczenie usługi zostało przerwane, nie jest zwracany Uczestnikowi.


    § 5 OBOWIĄZKI ORGANIZATORA

    1. Organizator ma prawo:

    a) Odmówić Uczestnikowi świadczenia Usług na warunkach niniejszej Oferty.
    b) Prowadzić zdjęcia i nagrania wideo podczas świadczenia Usług oraz wykorzystywać uzyskane materiały według własnego uznania.
    c) Tworzyć Pakiety Uczestników, opracowywać programy, tematy i czas trwania Usług świadczonych Uczestnikom, ustalać termin realizowania Usług, zmieniać (przenosić) i anulować, ustalać liczbę i skład aktorów występujących podczas świadczenia Usługi.
    d) Na podstawie otrzymanego od Uczestnika adresu e-mail przeprowadzać masową wysyłkę informacyjnych komunikatów bez zgody Uczestnika i/lub osób, które podały swoje dane na stronie internetowej Organizatora. Zawsze zapewnimy Ci możliwość     rezygnacji z takich komunikatów, umieszczając link do rezygnacji z subskrypcji
    e) Zatrudniać do świadczenia Usługi lub jej poszczególnych części osób trzecich.
    f) W jednostronny sposób wprowadzać zmiany w warunkach niniejszej Oferty, w szczególności, ale nie wyłącznie, zmieniać zasady płatności za świadczenie Usług, wprowadzać zmiany w sposobie świadczenia Usług poprzez zamieszczenie nowej redakcji Oferty na stronie internetowej.

    2. Obowiązki Organizatora:
    a) Świadczyć Usługi na warunkach niniejszej Oferty.
    b) Zachować informacje i dane (w tym dane osobowe) przekazane przez Uczestnika do realizacji warunków niniejszej Oferty zgodnie z obowiązującymi przepisami prawa w zakresie ochrony danych osobowych.
    c) Udzielać konsultacyjnego wsparcia Uczestnikom w sprawie usług Organizatora i warunków ich uzyskania na warunkach niniejszej Oferty.
    d) W pełni zwrócić Uczestnikowi środki pieniężne wyłącznie w przypadku pełnego anulowania przez Organizatora opłaconych przez Uczestnika Usług. Zwrot pieniędzy odbywa się w formie bezgotówkowej w ciągu 15 dni kalendarzowych od daty rezygnacji przez Uczestnika z opłaconych Usług.


    § 6 PRAWA I OBOWIĄZKI UCZESTNIKA

    1. Uczestnik ma prawo:

    a) Zwracać się do Organizatora w celu uzyskania informacji o Usługach Organizatora, warunkach ich świadczenia oraz warunkach niniejszej Oferty pod numerami telefonów podanymi na Stronie internetowej i/lub za pośrednictwem formularzy kontaktowych, a także pocztą lub innym środkiem komunikacji od 9:00 do 18:00 (GMT+2), z wyjątkiem sobót, niedziel i dni świątecznych, zgodnie z grafikiem pracy Firmy.
    b) Otrzymywać dowolną z proponowanych Usług Organizatora na warunkach niniejszej Oferty.
    c) Zrezygnować z otrzymania Usługi przed jej opłaceniem.
    d) Na warunkach Oferty nie można samodzielnie przenieść otrzymania w całości opłaconej usługi na najbliższą ustaloną przez Organizatora datę jej świadczenia, ale można indywidualnie uzgodnić z Organizatorem możliwość takiej zamiany pod warunkiem powiadomienia Organizatora na 7 dni roboczych przed niemożliwością otrzymania Usługi. Takie przeniesienie może nastąpić tylko raz i tylko za zgodą Organizatora.

    2.Obowiązki Uczestnika:
    a) Przed akceptacją Oferty zapoznać się z jej obowiązującymi warunkami.
    b) Wykonywać warunki niniejszej Oferty.
    c) Zapewnić terminowe stawienie się w celu otrzymania Usługi.
    d) Terminowo i w pełnym zakresie opłacać Usługi Firmy zgodnie z warunkami określonymi w niniejszej Umowie.

    3. Uczestnikowi zabronią się, chyba że jest to przewidziane dla konkretnej Usługi lub Pakietu uczestnika:
    a) Rozpowszechniać materiały związane ze świadczonymi Usługami w tym wideo i audio.
    b) Rozpowszechniać materiały Usługi w postaci transkrypcji, czyli tłumaczenie materiałów audio i wideo na format tekstowy, oraz/lub tłumaczenie na inne języki.
    c) Wykorzystywać uzyskane od Organizatora informację w celach komercyjnych poprzez tłumaczenie lub udostępnianie wiedzy i podstaw bez wcześniejszego uzgodnienia z Organizatorem.
    d) Wykorzystywać uzyskane od Organizatora informację, w tym (bez ograniczeń) w celu tworzenia podobnej i/lub konkurencyjnej usługi lub serwisu, lub w celu uzyskania korzyści komercyjnych lub finansowych bez wcześniejszego uzgodnienia z Organizatorem.
    e) Organizować i przeprowadzać własne wydarzenia lub zajęcia na podstawie Usług Organizatora.
    f) Podejmować działania mające na celu naruszenie warunków niniejszej Oferty.
    g) Udostępniać i/lub zapewniać dostęp do Usług osobom trzecim, z wyjątkiem warunków niniejszej Oferty.
    h) Dopuścić do rozpowszechnienia fałszywych, nieprawdziwych informacji, informacji szkalujących godność, reputację biznesową Organizatora, wykładowców i innych osób, a także informacji nawołujących do międzynarodowej, etnicznej nietolerancji, wrogości, wojny, zmiany ustroju państwowego krajów, informacji, których rozpowszechnianie jest zakazane obowiązującymi przepisami polskiego prawa i normami prawa międzynarodowego w zależności od terytorium świadczenia Usług.

    4. Podejmować inne działania, które nie są przewidziane w Ofercie, ale zawierają elementy przestępstwa karnego lub administracyjnego, lub naruszają prawa i interesy Organizatora, innych Uczestników i/lub osób trzecich

    § 7 CENA USŁUG I WARUNKI PŁATNOŚCI

    1. Cena usług Organizatora za pakiety uczestników (jeśli dostępne są pakiety uczestników) jest publikowana na stronie internetowej i może ulegać zmianie w zależności od zbliżającej się daty świadczenia usługi. Informacje o aktualnej cenie usługi są umieszczane na stronie internetowej.
    2. Płatność jest dokonywana poprzez przekazanie środków pieniężnych na bieżące konto firmy w polskich złotych, a także w walucie obcej, takiej jak dolar amerykański / euro, poprzez płatność za pośrednictwem systemu płatniczego PayPal/Stripe/Wayforpay.
    3. Usługa jest świadczona przez firmę po dokonaniu pełnej, 100 (sto) procentowej opłaty przez uczestnika. Taka płatność oznacza zapoznanie się i pełną zgodę uczestnika na wszystkie warunki oferty.
    4. Uczestnik ma prawo płacić wartość usług w ratach, przy czym dla uczestnika ustalana jest cena usługi obowiązująca w momencie dokonywania płatności pierwszej raty.
    5. Momentem płatności jest zaksięgowanie środków pieniężnych na bieżące konto Organizatora zgodnie z wybranym przez uczestnika sposobem płatności.
    6. Na warunkach, które zostaną ogłoszone podczas świadczenia usługi, Organizator może zaproponować cenę promocyjną (cenę ze zniżką i ograniczonym terminem obowiązywania oferty) dla zakupu kolejnej usługi.
    7. Uczestnicy mają możliwość otrzymywania indywidualnych bonusów, przywilejów, zniżek od Organizatora według jej własnego uznania.
    8. Organizator może organizować bezpłatne webinary i szkolenia dla uczestników. Na takie bezpłatne webinary, maratony i szkolenia mają zastosowanie wszystkie warunki tej oferty.


    § 8 ODPOWIEDZIALNOŚĆ FIRMY I UCZESTNIKA. WARUNKI ROZSTRZYGANIE SPORÓW

    1. Organizator nie udziela Uczestnikowi żadnych gwarancji dotyczących świadczonych usług, w tym (ale nie ograniczając się do): ciągłości, terminowości, bezpieczeństwa, bezbłędności, dokładnego dopasowania w celu rozwiązania konkretnych kwestii i oczekiwań Uczestnika.
    2. Uczestnik ponosi pełną odpowiedzialność za konsekwencje wszelkiego rodzaju, w tym, ale nie wyłącznie, za oczekiwane rezultaty i wyniki uzyskanej usługi, które mogą wyniknąć z jej świadczenia przez Organizatora.
    3. W przypadku udostępnienia przez Uczestnika świadomie fałszywych danych, zgodnie z § 9 pkt 5 Oferty, Organizator nie ponosi żadnej odpowiedzialności, a roszczenia takich Uczestników nie są rozpatrywane.
    4. W przypadku zakłóceń w funkcjonowaniu sieci Internetowej, sprzętu, oprogramowania Uczestnika, Organizator nie ponosi odpowiedzialności za niemożność świadczenia usługi.
    5. Organizator nie ponosi odpowiedzialności za żadne szkody poniesione przez Uczestnika, w tym, ale nie ograniczając się do, wynikające z działań lub zaniechań, udzielania nieprawdziwych informacji innym Uczestnikom.
    6. Łączna odpowiedzialność Organizatora za wszelkie roszczenia i/lub reklamacje (w tym, ale nie ograniczając się do, niewykonania warunków Oferty) nie może przekraczać kwoty opłaconej przez Uczestnika za Usługę Organizatora.
    7. Organizator nie jest placówką edukacyjną i nie zajmuje się żadną działalnością edukacyjną (pedagogiczną).
    8. Organizator nie ponosi odpowiedzialności za uzyskanie wyniku niezgodnego z oczekiwaniami Uczestnika, ponieważ sukces wykorzystania przez Uczestnika uzyskanej informacji zależy od wielu nieznanych Organizatorowi czynników: determinacji, wytrwałości, innych jego indywidualnych cech i charakterystyk osobistych.
    9. Organizator nie ponosi odpowiedzialności za niezgodność treści Usługi z oczekiwaniami Uczestnika. Treść Usługi stanowi prywatną opinię wykładowcy, która może się różnić od opinii Uczestnika.
    10. W żadnych okolicznościach Organizator nie ponosi odpowiedzialności wobec osób trzecich za wykorzystanie odnośników i informacji uzyskanych przez Uczestnika w trakcie Usługi i przekazanych przez niego, a także za podejmowane decyzje i/lub przez Uczestników i/lub przez osoby trzecie na podstawie informacji uzyskanych przez Uczestników w trakcie świadczenia Usługi przez Organizatora.
    11. W żadnych okolicznościach Organizator nie ponosi odpowiedzialności wobec Uczestnika i/lub wobec jakiejkolwiek trzeciej osoby za jakiekolwiek bezpośrednie i/lub pośrednie szkody wynikłe z jakiegokolwiek korzystania z informacji ze Strony lub z jakiejkolwiek innej strony internetowej, do której prowadzi odnośnik ze Strony, wynikające z dostępu, korzystania lub niemożności korzystania ze Strony, informacji uzyskanych od Organizatora podczas świadczenia jakiejkolwiek Usługi.
    12. Organizator nie ponosi odpowiedzialności za niewykonanie lub nienależyte wykonanie swoich zobowiązań na mocy niniejszej Oferty, jeżeli takie niewykonanie lub nienależyte wykonanie jest spowodowane działaniem siły wyższej (okoliczności nadzwyczajnych). W przypadku wystąpienia wobec Organizatora okoliczności nadzwyczajnych, powiadamia on o nich na Stronie nie mniej niż 10 (dziesięć) dni kalendarzowych od daty ich wystąpienia.
    13. Wszelkie spory wynikające ze świadczonych usług winny być w pierwszej kolejności rozwiązywane polubownie.
    14. Jeśli odpowiedni spór nie może być rozstrzygnięty polubownie, będzie on rozstrzygany przez sąd właściwy dla siedziby Organizatora.


    § 9 WŁASNOŚĆ INTELEKTUALNA/PRAWA AUTORSKIE

    1. Z chwilą zawarcia umowy Uczestnik uzyskuje prawo dostępu do treści w  ramach świadczonych przez Organizatora Usług przez okres jego trwania. Treści te stanowią utwór w rozumieniu przepisów ustawy z dnia 4 lutego 1994 r. o prawie autorskim i prawach pokrewnych (Dz.U. z 2016 r., poz. 666 z późn. zm.), przeznaczone są do osobistego użytku Uczestnika. Uczestnik nie ma prawa zwielokrotniania, powielania, rozpowszechniania, wprowadzania do obrotu treści ani materiałów świadczonych przez Organizatora Usług, ani udostępniania tych treści osobom trzecim.
       2. Uczestnikom nie przysługuje prawo do utrwalania w żadnej formie treści i przebiegu świadczonych przez Organizatora Usług, bez pisemnej zgody Organizatora.
       3. Wszelkie prawa, w tym majątkowe prawa autorskie, prawa własności intelektualnej do: nazw usług, domeny internetowej oraz zawartej na niej treści, w tym treści świadczonych przez Organizatora Usług oraz powiązanych materiałów, należą do Organizatora, a korzystanie z nich może następować wyłącznie za zgodą Organizatora.

    § 10 INNE WARUNKI

    1. Cała informacja handlowa między Organizatorem a Uczestnikiem, w tym, ale nie wyłącznie, informacje o Organizatorze, Uczestnikach, osobach trzecich, technologii, uznawana jest za poufną.

    2. Administratorem danych osobowych Uczestnika jest Organizator (YULIIA YASENYTSKA – PSYCHOLOG, ul.Grochowska 42/29, 04-282 Warszawa, wpisana do Rejestru Przedsiębiorców CEiDG pod numerem NIP 5252958113).

    1. Uczestnikowi przysługuje prawo wglądu i prawo do wykreślenia udostępnionych danych osobowych. Oświadczenie w tym zakresie powinno zostać przesłane pisemnie na adres Organizatora.
    2. Uczestnik, podając dane osobowe, oświadcza pod rygorem odpowiedzialności prawnej, że:
      a. są one zgodne z prawdą,
      b. wyraża zgodę na przetwarzanie tych danych przez Usługodawcę w celach i w zakresie określonym podczas rejestracji.
    3. W celu przetwarzania danych osobowych, które zostały wymienione w § 9 pkt. 4 niniejszej Oferty, mogą być przetwarzane imię, nazwisko, numer telefonu kontaktowego, adres e-mail oraz dane ankietowe.
    4. Dane osobowe przetwarzane w celu zawarcia lub wykonania Umowy lub udostępniania treści webinarium oraz wypełnienia obowiązku prawnego Usługodawcy będą przechowywane przez okres obowiązywania Umowy, a po jego upływie przez okres niezbędny do: posprzedażowej obsługi Zamawiających (np. obsługi reklamacji), zabezpieczenia lub dochodzenia ewentualnych roszczeń przysługujących Organizatorowi, wypełnienia innych obowiązków prawnych Organizatora (np. wynikających z przepisów podatkowych lub rachunkowych).
    5. Dane osobowe przetwarzane na potrzeby marketingu produktów lub usług własnych YULIIA YASENYTSKA – PSYCHOLOG, ul. Grochowska 42/29, 04-282 Warszawa, wpisana do Rejestru Przedsiębiorców CEiDG pod numerem NIP 5252958113 na podstawie uzasadnionego interesu prawnego będą przetwarzane do czasu zgłoszenia sprzeciwu przez osobę, której dane dotyczą; dane osobowe przetwarzane na podstawie odrębnej zgody będą przechowywane do czasu jej odwołania lub upływu okresu, którego zgoda dotyczyła. W przypadku udzielenia zgody na przetwarzanie przez Organizatora danych transmisyjnych dla celów marketingu usług telekomunikacyjnych Organizatora dane będą przetwarzane jedynie przez okres obowiązywania Umowy. Dane osobowe (kontaktowe) Zamawiających mogą być przekazywane podmiotom współpracującym z Organizatorem przy organizacji webinarium.
    6. W zakresie ochrony danych osobowych Uczestnikowi przysługują następujące uprawnienia:

    1) prawo dostępu do treści swoich danych osobowych, czyli prawo do uzyskania potwierdzenia, czy Organizator przetwarza dane, oraz informacji dotyczących takiego przetwarzania,

    2) prawo do sprostowania danych, jeżeli dane przetwarzane przez Organizatora są nieprawidłowe lub niekompletne,

    3) prawo żądania od Organizatora usunięcia danych,

    4) prawo żądania od Organizatora ograniczenia przetwarzania danych,

    5) prawo do przenoszenia danych, czyli prawo do otrzymania dostarczonych Organizatorowi danych osobowych oraz przesłania ich innemu administratorowi,

    6) prawo wniesienia sprzeciwu wobec przetwarzania danych na podstawie uzasadnionego interesu Organizatora lub wobec przetwarzania w celu marketingu bezpośredniego,

    7) prawo wniesienia skargi do polskiego organu nadzorczego lub organu nadzorczego innego państwa członkowskiego Unii Europejskiej, właściwego ze względu na miejsce zwykłego pobytu lub pracy osoby, której dane dotyczą, lub ze względu na miejsce domniemanego naruszenia RODO,

    8) prawo do cofnięcia zgody w dowolnym momencie (bez wpływu na zgodność z prawem

    przetwarzania, którego dokonano na podstawie zgody przed jej cofnięciem),

    9) prawo do uzyskania interwencji człowieka (np. pracownika) ze strony Organizatora, wyrażenia własnego stanowiska i do zakwestionowania decyzji opartej na zautomatyzowanym przetwarzaniu danych.

    1. Postanowienia niniejszego paragrafu stosuje się odpowiednio do Uczestników, jeżeli Organizatorowi zostały przekazane do przetwarzania ich dane osobowe.
    2. W przypadku rezygnacji przez Uczestnika otrzymania Usługi, jakiekolwiek roszczenia Uczestnika w tej sprawie nie są akceptowane i nie są rozpatrywane przez Organizatora.
    3. Uczestnik otrzymuje Usługi zgodnie z warunkami niniejszej Oferty tylko po spełnieniu wszystkich obowiązkowych warunków dopuszczenia Uczestnika do otrzymania Usługi.
    4. Oferta została zatwierdzona przez Organizatora i obowiązuje przez cały okres świadczenia Usług.
